Should I File a Police Report?

After a traffic accident, you should always file a police report, regardless of who is at fault for the collision. There are many reasons to file a crash report. A police report is an official documentation of the crash, and you can potentially use this report to prove the date, time, location, and other details of the incident. The report enables you to prove how the crash took place and other circumstances of the event. These details can be important later if you decide to pursue a personal injury claim. The police will arrive at the scene to take information, gather statements from witnesses, direct traffic, contact medical assistance, and help you get your vehicle to a safe location.

When to File a Police Report

Should I File a Police Report After a Car Crash?

The best time to file a police report is immediately following the wreck. Contact the police and do not leave or move your car.

The police only respond to serious crashes, or they may tell you to file your report later. The sooner you file a report, the better, because if you wait, it will become more difficult to prove that your injuries were caused by the accident.

Keep in mind that the other driver could deny liability or even argue that the crash never took place. It is in your best interest to contact the police and file a report as soon as possible.

Under Texas Law, You May Have to Report a Crash

Texas law mandates that you file a crash report under certain circumstances. You have to report any crash that caused damage exceeding $1,000 or where anyone was injured or killed. You have to file a report within ten days after the time of the crash. The penalty for failing to file a report could include penalties of $5,000 and jail time.

There are some key things to keep in mind after an accident. Provide the other driver and the police with key information, including your driver’s license, insurance, and registration documents. Take pictures of the crash site and any property damage. Seek medical treatment as soon as you can and obtain copies of all your medical reports and expenses.
