When Will I Receive My Personal Injury Settlement?

  • Signing the release. You must sign the settlement release before the insurance company can issue a check. Because you agree to give up your claim in exchange for the money you receive in the settlement, your case is effectively closed at this point. 
  • Processing the release. The insurance company will conduct a final review and process the settlement release after it has been signed. The insurance company will usually send the check to your attorney after this step is completed.
  • Depositing the check. The majority of personal injury lawyers work on a contingency fee basis, which means they will cover all of your case’s upfront costs. They are compensated by taking a cut of your settlement. So, when your attorney receives your settlement check, they will deposit it and deduct their fees and other costs from the amount. 
  • You receive your payment. You will get the remainder of your settlement after your lawyer has collected their fees.

It usually takes four to six weeks to complete all of these steps. However, each personal injury case is unique, and the time it takes to receive your settlement can vary depending on a variety of factors.
